Jammu and Kashmir High Court Dismisses Custodian General’s order

The High Court has set aside the order of the Custodian General of Jammu and Kashmir dated February 16, 2015, in which he had cancelled the allotment of twenty kanals of land allotted to the National Welfare Trust at Chauadi.

It was argued on behalf of the trust that twenty kanals of land had been allotted to the trust from the custodian property on behalf of the department, and a formal agreement was also reached on this, but later without any reason and without issuing any notice to the trust, the Custodian General Allotment cancelled. The High Court dismissed the order of the Custodian General, calling it legally wrong. The High Court, again sending the case to the Custodian General, directed him to issue notice to the trust and look into it after hearing the side of the trust as per rules.

The High Court has directed to submit a report on the current status of the construction of the Munsif Court building at Mendhar. In addition, the High Court directed the Additional Advocate General to submit a report after taking information about the work being done at the ground level. The High Court gave these directions during the hearing in the Public Interest Litigation filed by the Bar Association Mendhar.

The bench observed that the executive engineer of Poonch Division of PWD had prepared the DPR for the construction of the building at Mendhar at the cost of Rs.1234.60 lakh, which has been approved by the Chief Justice and was also submitted to the Secretary, Law Department on December 30, 2021. So sent but nothing is clear about the situation after that, so a new status report should be presented.
